Legal aspects of rail travel Delay compensation for Einzelticket, Wochenticket, Monatsticket

What rights do I have with a Einzelticket, Wochenticket or Monatsticket? What do passengers have to bear in mind and how do they assert their claims?

For an Einzelticket, currently only for long-distance travel in Austria, this means: In case of a delay of more than 60 minutes you receive 25% of the ticket price back, in case of a delay of 120 minutes you receive 50% of the ticket price back. The proportionate price per direction is reimbursed for return tickets.

For Wochentickets and Monatstickets (this also applies to Wochentickets and Monatstickets in a transport alliance), companies and transport alliances can determine the amount of compensation themselves. The largest Austrian railway company, ÖBB-Personenverkehr, compensates a lump sum of EUR 1.50 per delay of more than 20 minutes. The legal basis is Article 17 of Regulation (EU) no. 1371/2007.

KlimaTicket and Zeitticket holders must inform themselves about the conditions for compensation on the respective railway companies’ websites, in some cases (e.g. with ÖBB-Personenverkehr for Wochentickets and Monatstickets or with the Österreichcard), confirmations of delay must be submitted. Compensation must only be paid out for a minimum amount of EUR four. The company may exclude compensation below this.

Claims from all other Zeittickets (KlimaTickets outside the network region, Monatstickets and Wochentickets) are asserted differently (e.g. by collecting delay confirmations) and can be seen on the respective railway companies’ websites.
