Legal aspects of rail travel Delay compensation for VVT KlimaTicket holders

What rights do I have with a VVT KlimaTicket? What do passengers have to bear in mind and how do they assert their claims?

Passengers who have a valid VVT KlimaTicket are entitled to compensation if they mainly use railways (more than 50% of all trips) and if train delays or cancellations occur repeatedly on the railway lines they use during their KlimaTicket’s period of validity.

With this in mind, the relevant railway companies operating in Tyrol (EVU), ÖBB-Personenverkehr AG and DB Regio AG, have adopted compensation regulations and adapted their Fare Conditions and Conditions of Carriage accordingly.

Legal regulations (Railway Transportation and Passenger Rights Act dated 1 July 2013, BGBl. I no. 40/2013) were passed in Austria regarding the rights and obligations of rail passengers.

Registering for delay compensation proceedings

In order to enforce this compensation regulation together with the RUs, we need some additional information from KlimaTicket customers by filling out a participation form. Participation in the railway companies’ delay compensation proceedings is unfortunately not possible without this information and the provision of incorrect data means that any liability for compensation is no longer applicable.
